This Extension Privacy Policy explains how Accuweather’s extension partners – such as Mocha.Global – its affiliates, and subsidiaries (“Company,” “we,” “us,” or “our”) collect, receive, use, and share information about users (“users” or “you”) of the Accuweather desktop web browser extension software and related online services (“Services”). Note: This Extension Privacy Policy does not govern the collection and use of data on Accuweather’s website (www.accuweather.com) or sites or mobile applications that belong to Accuweather and/or Company, which will each have their own privacy policies and practices. Overview of Services

We build desktop web browser extensions that allow you to engage with unique content from Accuweather that we think you will love (“Extension(s)”). As part of our Services, we provide you with notifications and alerts (collectively, “Messages”) and other tools in the Extension that allow you to gain access to exclusive deals and services offered by Accuweather that match your interests in the most relevant moments to you.

What Information Do We Collect and/or Access?

When you install an Extension, we collect and/or access the following information about you (“Information”):

  1. Information You Provide to Us.  We collect and store any information you directly provide to us. This may include your first and last name, email address, social media information, phone number, and any other similar contact information you may provide to us when you contact us with questions or comments via email or any other communication channels.
  2. Information about Your Browser. This includes information about your browser type, browser language, browser settings, and information from “cookies”.
  3. Information about Your Device. This includes information about your IP address, the type of device you use when using our Services, your operating system, the make and model of your device, your device’s unique identifiers, and the Internet Service Provider used by your device.
  4. Information about Your Interactions with the Extension. Depending on which Extension you use, this may include data about the unique identifier associated with the Extension you use, how you engage with messaging or content from Accuweather via the Extension (for example, whether you open or close a Message and when you take such action), keywords searched in toolbars provided via the Extension, URLs and domain names of websites you visit, the date and time of such visits, and your general location (city, state, country, or zip code).
  5. Aggregated Data.  We may use your device, usage, and other activity data in aggregated form. This means that such data is used for statistical and/or user activity trends analysis purposes. This data does not directly or indirectly reveal your identity and cannot be linked back to you as an individual.
  6. Data from Third Parties. We may also obtain data from Accuweather, Vendors, and each of their third-party service providers (collectively, “Third Parties”). We protect such data according to the practices described in this Extension Privacy Policy, plus any additional restrictions imposed by the third party. For example, Accuweather may send us your contact information so that we can provide you with technical support for the Extension.

How Do We Use Your Information?

We use the Information which you share and which we collect about you for the following legitimate business purposes:

  1. Providing and Improving our Services. We use the Information we collect to improve the Extension and provide you with our Services, which may include:
  1. Security, Safety, and Dispute Resolution. We use data to protect the security and safety of Extensions, to detect and prevent fraud, to protect against misuse or unauthorized use of the Extensions and/or our Services, to resolve disputes, to enforce agreements, to limit our legal liability and protect our rights or to protect the rights, property or safety of other users or the public.
  2. Communications. If you contact us with any questions or concerns, we may use any personally identifiable Information that you provide to us in such communication to respond to you.
  3. Mergers and Acquisitions. If we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Information will likely be among the assets transferred.   2. Accuweather. We may share your Information with Accuweather with whom we have partnered to offer you an Extension and its related Services.

We may share your Information with law enforcement, regulatory authorities, courts with competent jurisdictions, emergency services or other necessary third parties when legally required to do so, to comply with a court order, to cooperate with police investigations, to enforce our rights, or for other legal proceedings.

Your browser may offer a "Do Not Track" (DNT) feature that can signal to operators of websites and web services (such as behavioral advertising services) that you do not wish for them to track your online activities over time and/or across various sites. Because there is not yet a common understanding of how to interpret the DNT signal, our Extensions and Services do not currently respond to browser DNT signals. We will continue to work with the online industry to define a common understanding of how to treat DNT signals.

How Long Do We Keep Your Information?

We only keep your personal data as long as it is necessary for the purposes set forth in this Extension Privacy Policy including for legitimate business purposes and as permitted by applicable law. We will only use your Information to the extent necessary to comply with our legal obligations, resolve any legal issues, enforce our agreements, and as otherwise described in this policy.

Where Do We Store and Process Your Information?

If you are a user based in the European Economic Area (“EEA”), you should be aware that the Information we collect and receive or permit Third Parties (such as Vendors) to process may be transferred to, stored and/or processed outside of your country of residence and in any country or territory where one or more of our affiliates, subsidiaries, parent companies, or Vendors (“Related Companies”) are located, including in the United States. Such Information will also be processed by personnel operating outside the EEA who work for us or for one of our Related Companies.

We rely on multiple legal bases to lawfully transfer personal data around the world. These include your consent and model contractual clauses created by the European Commission which require certain privacy and security protections. What Are My Personal Data Rights under the General Data Protection Regulation?

Company is a data processor for the purposes of the General Data Protection Regulation. This means that we are processing your personal data on behalf of Accuweather so that you can access Services of their choice via the Extension. Where we are using your personal data to provide you with our Services via the Extension, we are using such personal data as instructed by Accuweather with which we partner and to fulfill our contractual commitments to you and the Accuweather’s contractual commitments to you. For all other purposes, our legal basis is (1) our legitimate interest in running our business so that we can provide you with, improve, and create new products and Services through Extensions or (2) your consent,where we or Accuweather obtains your consent for use of your personal data for a specific purpose related to your use of Extensions.  

What Are My Data Rights As A California Resident?

Users who are California residents ("California Users") have certain rights with regard to Information classified as “personal information” according to applicable data privacy laws in California. Keep in mind that we may reject requests, for example, where your request is unlawful or adversely affects the rights of another person. You have the right to request that we:

    1. Delete your personal information;
    2. Provide access to categories of personal information which we have collected about you; and
    3. Provide access to specific pieces of personal information which we have collected about you.

If you are a California resident, you may designate an authorized agent to make a request to access or a request to delete on your behalf. We may deny requests from authorized agents who do not submit proof that they have been authorized by you to act on their behalf, or are unable to verify their identity within two (2) business days of submitting a request. In addition, for security purposes, you and/or your authorized agent will only be able to submit requests via the proper browser and device on which your Extension is installed.

California "Shine the Light" Rights

In addition, California Civil Code Section 1798 entitles California Users to request information concerning whether a business has disclosed personal information to any third parties for the third parties' direct marketing purposes. We will not sell or share your personal information with non-affiliated companies for their direct marketing purposes without your consent. Information Collected by Third Parties

Third Parties may use their own or their affiliates’ cookies within the Extension and via the Services to collect information about you, such as by dropping their own cookies when you click on a Message served on the Extension. We do not control such information collection and usage practices of these Third Parties. Therefore, we recommend that you review the terms and privacy policy on such Third Parties’ websites.

Children’s Privacy

Except where specified within an Extension, we create our Extensions for the exclusive use of users aged 13 and older (or 16 and older if you are in the EEA). We do not knowingly collect Information from children under the age of 13 years old (or 16 years old in the EEA). If you are under 13 years old (or 16 years old in the EEA), please do not install our Extensions or use our Services.

Changes to this Policy

If we change our privacy practices, we will post those changes to this Extension Privacy Policy or other places we deem appropriate so that you are aware of what Information we collect, how we use it, and under what circumstances, if any, we disclose it.
